There seems to be some discrepancies here. Again- not criticizing, I just want to know the law since I do have younger passengers on board from time to time.
The NJ state site says this:
One I, II, III, or V PFD for each person on board. Under state law, it is an infraction, punishable by a fine of up to $250, to operate a vessel unless every child 12 years of age or younger on board is wearing a Type I, II, III, or V Coast Guard-approved personal flotation device (life jacket). The law does not apply to: the operator of a vessel on which every child under age 13 is in an enclosed cabin. Inflatable PFDs - The U.S. Coast Guard approved inflatable PFDs in 1996.
(The only exception seems to be if the child is in the cabin)
The USCG site doesn't list any exceptions for NJ. They also clearly say that a type V is not legal for passengers under the age of 16, while the State site seems to contradict that.
Is there any Costies or Marine police here on the site that really knows?

I did let him take his PFD off just for this picture. Although after reading related posts I see that I misunderstood the definition of 'underway'. He fishes with me often and I have typically let him take it off while we're drifting for fluke in good conditions. Sounds like the definition of underway is actually anything but moored or anchored. No doubt a wiser approach...

I was the one who made the first comment about the life vest and the water being cold. I am not sure about the intent of the rest of the comments on here, but I asked a harmless question "where is his life vest?" and then made a harmless comment "the water is too cold to take any chances". It was not an attack. It was based upon my own opinion. This board is full of those on every thread. We have opinions on what baits to use, where to fish, what type of boat to buy, etc My kids dont get on my boat without a life vest on. You can call me anal retentive if you want and there is nothing wrong with you saying that to me. It would be your opinion and one that I would not dismiss without careful consideration. Are we going to continue to examine every post with a microscope and take everything personally here on Barnegat Fishin' Hole? Interestingly enough, tmactom did not seem to have a problem with it. He simply answered that his son had the life vest on and took it off for the picture...end of story. Jeff is also correct that we should all be wearing survival suits. It is a valid point even though most of us are not wearing them. I am not going to tell him...."mind your own business".
