That is kinda scary... I have two girls, 8 and 6. The only time they aren't in jackets are at the slip or when were rafted with friends swimming. I know they are both very capable swimmers and I have no problem throwing them off the boat, but for the little bit of whining and the extra minute it takes to buckle them, I'd rather bring them home with me.

My lil one shes 3 i have her wear one in the yard beings im on the water and its fenced in but u never know, im not here to raise anyones kids but it true my 8 yr kicks and screams when were on the boat because it gets in the way of her reeling in fish lol

Here is a question??? Do they make those inflatables for kids? The only thing I'd be worried bout with them is they get into a water fight and POOF!! They depoloy. Would scare them half to death but still would be kinda funny!!

AJ I don't belive so. I believe that the manual and auto-inflate PFD's are only USCG approved for ages 16 and older.

I lifted this from the USCG's site:

"Approved Inflatable PFD's are authorized for use on recreational boats by person at least 16 years of age."

NJ laws says anyone under the age of 13 must wear one at ALL times. There is no mention of being anchored, moored, or in the cabin.

I'm glad this came up because I fished this spring with a friend and his 8 year old daughter who was wearing an inflatable. When we got back to the ramp, the CG was there doing paperwork from an accident. They saw her on deck and asked her age, but then said "nevermind, she has an inflatable on". I guess they didn't know either.

I'm not criticizing the original poster. I just thought I would share some info.

I think this falls under "mind your own business". You dont know if that kid had a jacket on before the picture or not. The NJSP book states that a child under 16 needs a pfd "while underway". I know this because a trooper came up next to me and my son (10) while drifting and said he needed a vest. I politely said I thought that was only while under power. He looked at his book and agreed with me.
I use the common sense approach...My kids are vested while underway, crappy weather and ALWAYS in the inlet.

There seems to be some discrepancies here. Again- not criticizing, I just want to know the law since I do have younger passengers on board from time to time.

The NJ state site says this:

One I, II, III, or V PFD for each person on board. Under state law, it is an infraction, punishable by a fine of up to $250, to operate a vessel unless every child 12 years of age or younger on board is wearing a Type I, II, III, or V Coast Guard-approved personal flotation device (life jacket).
The law does not apply to:
the operator of a vessel on which every child under age 13 is in an enclosed cabin. Inflatable PFDs - The U.S. Coast Guard approved inflatable PFDs in 1996.

(The only exception seems to be if the child is in the cabin)

The USCG site doesn't list any exceptions for NJ. They also clearly say that a type V is not legal for passengers under the age of 16, while the State site seems to contradict that.

Is there any Costies or Marine police here on the site that really knows?

Loanfish, it was just an observation. If you post a picture here, you are inviting comments. My point was that the water is cold this time of year. You need to have a different mindset once the water gets cold. If a kid (or adult) falls over, he may just get shocked by the temp and may not even make it to the ladder on the boat. The trooper who stopped you obviously was just concerened for your kid.

There is also no law that requires you to chapparone your kid on a trip to NYC...it is just common sense.

I did let him take his PFD off just for this picture. Although after reading related posts I see that I misunderstood the definition of 'underway'. He fishes with me often and I have typically let him take it off while we're drifting for fluke in good conditions. Sounds like the definition of underway is actually anything but moored or anchored. No doubt a wiser approach...

Noone is trying to bash you tmactom. It is nice that we have a support system to weed through all the red tape of the law. I am alittle overprotective of my kids, but I have also witnessed alot of mahem on the water. Just my personal opinion. By the way, Nice fish!

Guys,

Yes the water is cold. SO ALL OF YOU SHOULD BE IN SURVIVAL SUITS. But your not so why bash someone else. Doesn't this fall under the people in glass houses should not throw stones.

If you fall in during this time of year your survival possibilities quickly diminish without the proper equiptment. A life jacket will aid in the recovery of your body but it will not help with exposure to the cold water.

I was the one who made the first comment about the life vest and the water being cold. I am not sure about the intent of the rest of the comments on here, but I asked a harmless question "where is his life vest?" and then made a harmless comment "the water is too cold to take any chances". It was not an attack. It was based upon my own opinion. This board is full of those on every thread. We have opinions on what baits to use, where to fish, what type of boat to buy, etc

My kids dont get on my boat without a life vest on. You can call me anal retentive if you want and there is nothing wrong with you saying that to me. It would be your opinion and one that I would not dismiss without careful consideration.

Are we going to continue to examine every post with a microscope and take everything personally here on Barnegat Fishin' Hole? Interestingly enough, tmactom did not seem to have a problem with it. He simply answered that his son had the life vest on and took it off for the picture...end of story.

Jeff is also correct that we should all be wearing survival suits. It is a valid point even though most of us are not wearing them. I am not going to tell him...."mind your own business".
